1. Definitions
'LocateA.net' or 'LocateA' means the website located at www.locatea.net, www.locatea.co.uk or www.locatea.eu
'website' means this website located at www.locatea.net, www.locatea.co.uk or www.locatea.eu
'user' means you, the master user or child users you allow to be tracked by our service whether it be by software or hardware.
'you' means you, the user or master user who is accessing or using our service or website.
'we' means LocateA.net.
'master user' means the person who first registered an account with the website.
'child user' means the person or persons the master user sub registers to use the service.
2. General
Master Users agree and acknowledge that they are solely responsible for their own Child Users including themselves.
Master Users must obtain permission from Child Users to acknowledge that Child Users under them have agreed and know they are being tracked at any time, and that the Master User has sole control over their ability to appear public.
LocateA.net Reserves the right to alter/vary/update these conditions without notice from time to time as LocateA.net sees fit, your continued use of our service binds you to any new/altered/updated conditions. If you do not agree with any new terms or conditions you should stop using our service immediately.
LocateA.net's end use is provided to you free of charge however this may not always be the case, if LocateA decides to start charging for its service a notice will be posted in our forums website news section giving 1 full calendar months notice of such charge.
3. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
a. LocateA IS PROVIDED TO YOU WITHOUT ANY WARRANTY, YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LocateA AND ITS LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
b. LocateA AND ITS LICENSORS MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE OR HARDWARE WILL BE CORRECTED.
c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE LocateA WEBSITE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM LocateA OR THROUGH OR FROM LocateA SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
4. RSS Feeds
While we allow Master Users and or Users to display their own maps on their own web pages, Master Users and or Users doing this must credit LocateA on their web site with a clickable link back to LocateA.net. Any Master User and or User found not complying with this basic requirement is subject to have their account terminated without notice or reason with the loss of all/any recorded data.
[ Updated 5/12/2007 ] Due to abuse of this service, LocateA will only activate your RSS feeds after a moderator has visited your map to confirm you credit LocateA with a clickable link. We should also be able to surf to your map page(s) easily from your main home page. LocateA now stores your map URL(s) in our database which actively checks at random your map page(s) for this link. If the link is not found by our script, your RSS feed is automatically disabled. If any of your RSS feed(s) are disabled 3 times or more by our script in any 12 month period the reactivation of the feeds will attract an admin charge of £250 + VAT.
If you really do not wish to credit LocateA with a clickable link then you can purchase a license to remove it, a license costs £100 per year + VAT for each domain.
Master Users and or Users who display their own maps using our RSS feeds accept, understand and acknowledge that 'google' DO NOT ALLOW their maps to be used for Vehicle Tracking in anyway whatsoever, and you further agree to be solely responsible for any action google may bring against you should you decide to use google maps. LocateA reserves the right to terminate your RSS feed without question, notice or reason, and if approached by google we will comply with their request to terminate your RSS feed should they ask us to. For the benefit of doubt, LocateA provide RSS feeds solely for use on the Microsoft Virtual Earth Platform.
5. Hardware / Hard Wired Tracking Devices
a. Only if you purchase a Hardware / Hard Wired Tracking Device from LocateA directly, will LocateA honour the hardware or hard wired units ability to update to our servers [ subject to clause 'c' below ]. For the benefit of doubt, any person or persons who purchase or obtain a Hardware and or Hard Wired Tracking Device capable of updating to the LocateA servers not directly from LocateA, LocateA and its services are provided solely at LocateA 's discretion.
b. In the unlikely event that LocateA is unable to continue to offer such free service to Users and or Master Users, LocateA will give 1 full calendar months notice of any charge it may be imposing to enable the service to continue, no refunds will be offered by LocateA. If you do not or will not pay such charges, you should contact the person, persons or company who you purchased the hardware or hard wired device from to enable re-programming of the unit to update to another service at your own expense.
c. If you purchase a hardware / hard wired tracking device from LocateA directly and in the unlikely event that LocateA is unable to continue to offer its free service to you, LocateA will give 1 full calendar months notice of any charge it may be imposing to enable the service to continue, or LocateA will give 1 full calendar months notice of the termination of its service. In the unlikely event of this happening, LocateA will do it's best to provide software for the Master User ONLY to enable the hardware or hard wired device to update to the Users or Master Users own website, but we will not be responsible for implementing this code on the users or master users web site. For the benefit of doubt, LocateA will only provide the BASIC php code to receive the update's that the hardware or hard wired device sends, it will not provide any database structure or programming required to store such received data.
6. Miscellaneous
These Conditions shall be subject to and construed in accordance with English law, and the parties submit to the exclusive jurisdiction of the English courts.
